The Second-Hand Goods Act of 2009 is expected to finally be implemented from January 1, 2012, Police Minister Nathi Mthethwa said on Wednesday.
He was responding to a written question by Pieter van Dalen of the Democratic Alliance, who wanted to know, among other things, the reason for the delay.
Mthethwa said to implement the Act it was necessary to take preparatory steps to effectively put into effect its provisions in a phased approach.
There were two sets of regulations to be promulgated under the Act.
The first regulated the accreditation of associations, while the second set regulated dealers and recyclers.
The regulations for associations were in the process of promulgation, while those for dealers needed to be formally “consulted with associations” as soon as they were accredited, then published for comments and finally promulgated, he said.
Different associations already existed and would be considered for accreditation as provided for in the Act.
“It is envisaged that the Act will come into effect on January 1, 2012. We will ensure that the Act is implemented as from January 1, 2012, subject to operational requirements.”
With the Act coming into operation, the necessary instructions would be issued and training and support to police stations continued on an ongoing basis, Mthethwa said. - Sapa
