Convicted fraudster Schabir Shaik was relieved to be back home and was sleeping, his brother Yunis said on Tuesday outside the family's house in Durban.

"He's sleeping because he is gravely ill," said Yunis Shaik.

He said the parole board had decided to release his brother after studying Schabir's medical records and determining he was "gravely ill".

"The terms and conditions of his release will apply as the same for all offenders.

"We will take advice from his doctors at this stage," he said.

"If you're thinking of getting a picture of him on crutches, you won't because he is sleeping," Yunis told reporters outside the Morningside home.

He explained that people who had been coming in and out of the property were correctional services and parole board officials, there to set down conditions for parole.

He said the family was happy he was back home.

"Most of the time he is on heavy medication... and we (the family) will stay with him for a short while for support and to sort out home care."

Yunis requested journalists to leave as other family members who wanted to see him could not, because they could not face the media camped outside the home. About 10 reporters and photographers were there.

Asked what Shaik had eaten today, Yunis said "next question".

Asked whether Schabir Shaik was terminally ill, Yunis said he was "gravely ill".

Shortly before 8am, a Citymed ambulance pulled up in front of the Shaik's home. It was followed by a bakkie full of correctional services officials. Shaik was taken inside on a stretcher.

Reporters earlier converged on Chief Albert Luthuli Hospital by 8.30am in anticipation of Shaik's release, but were told by hospital officials that he had already gone home. - Sapa

You need to make the distinction between the judicial system and the prison system. The ANC is fighting to control the judicial system - and getting somewhere as evident by the lack of prosecution of JZ. The prison system the ANC does control. That is why the likes of Tony Yengeni and Shabir are able to get out of jail so quickly. There is nothing we can do about it. Soon we will be a totally dictatorial society controlled by a corrupt ANC where rights mean nothing. It is just such a pity that the masses that vote for the ANC don't see this.

South African Law is BLIND! It all depend who do you know, from where and Why! We all know what terminally ill is. Depression has never been classified as a disease that can kill a person. What does the parole board think? Obviously Shaik was gonna be depressed of being in Jail!

William Tell let's hope you are right about the 6 months he has left and as for Anonymous, get a life, of course there was Government influence involved here. They had a nice little arrangement whereby Shaik did some very easy time in the prison hospital to take the heat off his mate, but now that JZ's star is rising Shaik is out enjoying life at home. What about all the others in prison who are dying of Aids - will their families get them home just as quick.

This makes me sick. Clearly there are double standards for corrupt businessmen and politicians (Yengeni). And as for that idiot who 'finds all these negative comments to be an infringement on human rights' - what a stupid doff comment. You are probably one of the Shaiks writing in under Anonymous. Shaik is 'gravely' ill, from what I understand not 'terminally' ill. This is a disgusting abuse of the judicial and prison systems and makes our judiciary look weak and without teeth. What good is it sending a criminal like Shaik (which he is) to jail if his corrupt political friends will simply give him a get out of jail free card?

Why is everybody so surprised at this release ? This was on Zuma's agenda for a while already. And next thing to happen : Mr Shaik will die ( and nobody will ever know from what exactly he died ), because dead people can't speak, in favor or against any person .... Wake up South Africa. This will be the rule for the coming years under ANC.

What process is followed when ordinary criminals fall sick ??? I doubt very much that they will be sent anywhere except a prison hospital !

Way to go ANC...trample the majority of people (of ALL colours) while the select few get preferential treatment. It's a relief to know that our beautiful country is in your hands...Eish!

If he's "gravely ill" why is not in a hospital?
