 State does not accept the facts - court hears

The state has declined to accept a guilty plea from one of the men accused of robbing and murdering Ballito building contractor Marcello Borsei, a Durban High Court judge heard yesterday.

"The State does not accept the facts," State advocate Sasha Jacobs told Judge Isaac Madondo.

The trial of S'busiso Mncwango, 23, and Mjabuliseni Buthelezi, 35, former employees of Borsei, was due to be begin last week but was adjourned until yesterday for negotiations over Mncwango's proposed plea. The men are charged with killing Borsei and then setting his body alight.

While Mncwango's defence counsel, Mluleki Chithi (corr), said he was prepared to amend the plea, Jacobs was adamant that this would not be acceptable.
