The ANC has lost its appeal against a Western Cape High Court judgment in favour of the George municipality following the disputed resignation of a DA councilor in March 2008.

The ANC had insisted that Henry Jones' resignation, which he later rescinded, was valid -a move that would have thrown open the balance of power in the municipality.

Both the DA and the ANC have 17 seats in the municipality which the DA runs in coalition with several smaller parties for a majority in the 39-seat council.

Unhappy at the DA over unkept promises of promotion Jones tendered his resignation in a letter to George municipal manager Cecil Africa.

But before Africa could read it Jones came to his office and changed his mind.

At DA meeting on March 30, Jones told his colleagues that he had "resigned impulsively, actuated by emotional pressure, and regretted the act".
