Cash-strapped rape accused freed

Komatipoort - A Mozambican man accused of raping his girlfriend's epileptic daughter was released on a warning on Friday after failing to raise R2 000 for bail in the Tonga Magistrate's Court.

The accused, Carlos Emanuel Nhamposse, 58, of Naas township, but originally from Inhambane in Mozambique, pleaded not guilty on Friday to a charge of rape, a Sapa correspondent reported.

“Sir, please go home and make sure you come back in July on the date given because failing to do so you will face the jaws of the law,” Magistrate Hazel Khoza said.

Last month, Nhamposse was granted R2 000 bail, which he failed to raise.

He is accused of raping his girlfriend's daughter, who is epileptic and mentally disabled.

Khoza warned Nhamposse to stay away from the victim and Mafambisa village, where she lives.

Nhamposse, who spoke in Shangaan, thanked God for his release.

“Nakhensa Xikwembu, nakhensa ningeyi eMafambisa (Thank you God, thank you, I won't go to Mafambisa),” he said.

The barefooted man, who was arrested on April 3, also thanked the magistrate as he left court.

The court previously heard that the victim's age was unclear.

Investigating officer Constable Nokuthula Luphoko testified: “We cannot determine whether she is 20 years old or more, but her mental condition is serious because she thinks like a child who is less than 10 years old”.

Luphoko also told the court that the accused admitted to having sex with the her.

“The accused also agreed that he had consensual sex with her and that they did it twice,” she said.

The matter was postponed to July 3 for further investigation.
