Cape Town - Rosemary Theron’s 18-year-old daughter, Phoenix Racing Cloud Theron, and her boyfriend, Kyle Maspere, 19, arrested for the murder of the Clovelly woman, will apply for bail on October 10.
On Tuesday a Legal Aid attorney, Kezia Lackay, appeared for Theron and Maspere in the Simon’s Town Magistrate’s Court.
They remain in custody while a third suspect, Godfrey Scheepers, 20, was granted bail of R500 on Monday.
Scheepers was represented by defence attorney Leon van der Merwe when they all appeared in the dock.
Following a brief court appearance, presiding magistrate Crystal McKenna postponed the matter to next Thursday.
Scheepers’s bail was extended.
The trio were arrested on Thursday after Scheepers approached the Fish Hoek police and confessed to having information about a missing person, the court heard this week.
The three appeared in court for the first time on Monday, when the State alleged that Maspere strangled Theron with a rope while Phoenix hugged her.
The State claimed that in February this year mother and daughter had an argument. Theron then went out and in her absence Phoenix and Maspere, who were smoking drugs, discussed killing her.
When Theron returned, Phoenix hugged her, apologised for the fight, then held her mother as Maspere allegedly strangled her with a rope.
Phoenix and Maspere then buried Theron in a field close to Theron’s home in Clovelly, the State said.
In March, Phoenix formally reported her mother missing, and Theron’s friends and relatives went to extensive lengths to try to find her. A private investigator was hired and funds raised to support her children and to pay for the investigator. Missing persons’ pamphlets were distributed, claiming Theron had last been seen leaving her home with a long-haired blond man.
Some months later, according to Scheepers’s confession to the police, Scheepers said Maspere approached him to talk about moving Theron’s body.
Theron’s body was found in a shallow grave near the Strandfontein Pavilion off Baden Powell Drive last week after a pointing-out.
The bail application is set to continue next week.
