ConCourt to rule on Armscor dismissals

Johannesburg - The Constitutional Court will give judgment on Tuesday on the dismissal of two Armscor executives by Defence Minister Nosiviwe Mapisa-Nqakula.

According to court documents, Mapisa-Nqakula fired Armaments Corporation of SA Limited (Armscor) board chairman Mojo Motau and deputy chair Refiloe Mokoena on August 8 last year.

The two applied to the High Court in Pretoria to have the decision overturned.

On September 18, the court set aside their dismissals, declaring them unconstitutional, unlawful, and invalid.

The minister subsequently approached the Constitutional Court.

According to court papers, Mapisa-Nqakula said she had “good cause” to fire them. She said they failed to provide leadership, resulting in extreme delays in delivery of equipment for SA National Defence Force troops deployed on the continent.

She argued the high court erred in finding her decision invalid.
