Cow costs owner after causing crash

Pretoria - The cow of a Modimolle farmer, from Limpopo, will cost her owner dearly as the beast caused an accident in which a motorcyclist collided with the animal after it wandered on to a public road.

Carel Hallatt Roos, 47, is claiming R700 000 in damages from the beast’s owner, Lourene Ferreira of Doringdraai Farm in Modimolle. He also wants the R15 978 he spent on repairing his motorbike. Roos is blaming Ferreira in papers before the Pretoria High Court for his misfortune, as a result of which he suffered spinal and neck injuries, as well as fractured ribs.

He stated that he was riding his bike on the Kranskop/Jasper Road on the night of March 22, 2008. A car approached from the front and he tried to swerve. This was when he saw a “big brown cow”.

He collided with the animal, which had to be put down. Roos blamed the accident on Ferreira, whom he said had a responsibility to see to it that her cattle were locked up.

Ferreira said Roos was driving too fast and braked too late.

It was, however, on Friday agreed that she would pay 70 percent of the damages which Roos can prove he suffered in the accident.
