Cape Town - A ballistics expert took measurements of the VW Sharan in which Anni Hindocha had been killed after the original back seats had been ripped out and replaced.

In addition, when investigators carried out a re-enactment of the incident, to test various positions the shooter could have fired the shot from, the seats were not in the same position as they were in photographs of the crime scene.

This emerged in the Western Cape High Court on Wednesday when Pieter Engelbrecht testified in the trial of Shrien Dewani, who stands accused of orchestrating Anni's murder while he and she were on honeymoon in Cape Town in 2010.

The measurements are central to Engelbrecht's findings that the direction of the gunshot that killed Anni came from the front left of the vehicle towards the back right.

He told the court that he could not say where the shooter was and could only express an opinion on the direction that the gunshot had been fired.

However, during cross examination, the defence suggested he was trying to mislead the court.

Engelbrecht was forced to make several concessions after defence advocate Pieter Botha referred him to evidence he had given in the trial of Xolile Mngeni, who was found to have fired the fatal shot.

In that trial, Engelbrecht testified that the shooter was in the front passenger seat.

On Wednesday, after it was put to him that he had no basis for such evidence, he said that he may have misunderstood the questions put to him then.

He conceded that his answer could have misled the court in Mngeni's trial.

The trial continues.
