Durban - A 66-year-old woman said she was happy that one of the men who gang-raped her would spend the next 25 years in prison.
Magomevu Mthembu, 22, was sentenced by Pietermaritzburg High Court Judge Isaac Madondo to an effective 25 years for the rape and robbery of the woman .
Mthembu and two accomplices broke into the woman’s house on the night of December 18, 2010, and took turns raping her before they fled with R30 in cash.
Mthembu’s accomplices are still at large.
Judge Madondo said there were mitigating factors which justified a sentence less than life.
These factors included that Mthembu was a young first offender capable of rehabilitation.
The judge said aggravating factors included that the woman was elderly and badly injured as a result of the gang-rape. Attacked in the sanctity of her own home, “she now lives in constant fear and has nightmares about the incident,” Judge Madondo said.
He said that it was also disturbing that Mthembu was the woman’s neighbour and had been born and raised in front of her. “You should have been a person she could look to for protection, instead you committed a vicious and brutal assault on her,” he said.
”I am still so scared and sad about what has happened to me. God spared my life so I could see this day, when justice is done,” the frail woman, who was present in court, said after the sentencing.
