Ex-cops in dock for CBD assault

Cape Town - Two former police officers filmed allegedly kicking a naked Nigerian man appeared in the Cape Town Magistrate's Court on Friday morning.

David Gunn, 43, and Gerrit Januarie, 46, both of whom were warrant officers at the time of the alleged incident, appeared before magistrate Alta Frederick on a charge of assault with intent to do grievous bodily harm.

They were told to be back in court on August 18 and 19 for pre-trial proceedings.

“Your bail is extended and all bail conditions are to be observed except reporting to police stations,” Frederick said.

In March, a woman in a building in the Cape Town CBD used her cellphone to record the alleged incident in the street below.

The video clip went viral on social media after it was posted online.

Gunn was dismissed from the police after disciplinary action, but Januarie resigned before disciplinary action could be taken against him.

They seemed relaxed before their appearance and both wore jeans and black tracksuit tops. Once in the dock, they stood with their hands clasped and showed little expression.

Under their bail conditions, they may not try to make contact with any witnesses or visit or speak to ex-employees of the Cape Town central police station. They are also not allowed to visit the Sky nightclub in Riebeeck Street, near where the alleged assault took place.

At their first appearance, the court ordered that the victim's name not to be published. The order also applies to the names and identities of all witnesses.
