Garage killing accused gets bail

Cape Town - The businessman arrested for allegedly shooting dead a 23-year-old Woodstock man at a filling station has been granted bail after his attorneys filed an urgent high court application.

Lawyer Noorudien Hassan said on Thursday they made the application following a ruling at the Cape Town Magistrate’s Court that David Forbes, 48, be denied bail.

Bail was set at R20 000.

Up until Wednesday afternoon, Forbes had been held at Cape Town Central police station following the shooting of Moegamat Toufiq Joseph on Saturday.

Joseph was killed during what appeared to be an altercation between the two while he was seated inside a black Golf GTi in the parking area of the Engen garage in Orange Street.

During his bail application it was revealed in witness statements Forbes had given instructions to call the police, and waited at the scene after the shooting.

Forbes’s defence argued he had acted in self-defence.

It was also revealed that at the time of the shooting, Joseph had been involved in an ongoing murder case at the Cape Town Regional Court. However, he was only charged with housebreaking with the intent to steal and theft.

The investigating officer alleged four knives had been found in Joseph’s car, one of which was marked with blood.

Magistrate Nikki Oakes said the court would not place too much weight on Joseph’s pending matter because the merits of the case were not known.
