Durban - The suspended head of the Hawks in KwaZulu-Natal, Major-General Johan Booysen will have to wait until early October before a date can be set down in the Durban High Court for his urgent application against his suspension.

Booysen had been set to challenge his suspension last week by national head of the Hawks Major-General Berning Ntlemeza in the Durban High court on Monday, but the legal team for the Hawks indicated they would be opposing the application.

On Monday, the two parties agreed that they would be meeting with Judge President Achmed Jappie on October 7 to set down a date for the application to be heard. By that date, all papers and replying papers needed to have been lodged with the Durban High Court.

Booysen has been suspended amid allegations of fraud amounting to R15 000 - an allegation he hotly denies.

This is the third time Booysen has been suspended. He was suspended in March 2012 by then Hawks boss Anwa Dramat. Later that year in September, Booysen was again suspended following allegations of racketeering.

He returned to work in September 2014 after Durban High Court Judge Trevor Gorven dismissed the charges against him, finding that then acting National Director of Public Prosecutions Nomgcobo Jiba had no reasons for prosecuting him.

Following the Gorven judgment, a police internal disciplinary inquiry headed by advocate Nazeer Cassim SC also cleared Booysen of all wrongdoing.

“The facts demonstrate an agenda to get rid of Booysen because he was perceived (rightly so, I may add), as a determined, professional, competent, and tenacious policeman,” said Cassim in his ruling.
