Durban - The head of the Hawks in KwaZulu-Natal is being investigated for alleged fraud.

Major-General Johan Booysen’s lawyer, Carl van der Merwe, confirmed on Thursday that his client had been served with a “contemplated notice for suspension”.

Van der Merwe said it invited Booysen to reply to allegations that he had submitted a document using a wrong date.

“We are putting together a response now, but what I can say is there is a lot going on behind the scenes.”

He said Booysen had until Monday to reply.

“We haven’t been served with the documents. They still have to investigate and we will receive them only if they decide to charge him formally. It’s still in the preliminary stages.”

While Van der Merwe said he did not want to go into the merits of the case it was “definitely related” to the 2012 case.

“It’s sensitive because we are compiling a response.”

In that case Booysen was charged with murder and racketeering by then acting national director of public prosecutions, Nomgcobo Jiba.

He was charged with 28 other members of the former Cato Manor organised crime unit, which he led.

Charges against Booysen were eventually thrown out by Durban High Court Judge Trevor Gorven, who at the time described Jiba’s decision to charge Booysen as “arbitrary” and “unconstitutional”.

Booysen had been accused of running a criminal enterprise comprising members of the former Cato Manor unit.

Police spokesman, Lieutenant-General Solomon Makgale, could not immediately comment on the matter and would make enquiries first.
