Johannesburg - Former bouncer, boxer and self-confessed hitman Mikey Schultz won’t have to worry about the assault charges against him any longer, as the case was dropped on Thursday.
Schultz was accused of assaulting complainant Ashraf Cajee outside the Sandton nightclub Taboo in May last year.
Cajee claimed he was accosted by Schultz when he and his wife were leaving the club after dropping off their son for his birthday. It was alleged that Schultz had bit Cajee’s cheek and, along with several friends, had beaten him.
But missing dockets and absent prosecutors stalled the case for months, and after Cajee was unable to attend court proceedings on Thursday morning, magistrate Hombokazi Twele had had enough.
The trial was set to start on Thursday at the Randburg Magistrate’s Court, but Cajee’s wife had allegedly called prosecutor Tebogo Monareng in the early morning to say her husband had been in a car accident and would be unable to testify.
Twele said the case had stalled numerous times, including in March, when Cajee had allegedly dropped the charges before being convinced otherwise by the State.
She agreed with the defence that the complainant did not have enough interest in the case and had not provided any legitimate proof, such as an accident report.
The case was dropped from the court roll, and a beaming Schultz left the court moments later.
Monareng was unwilling to comment on whether the case would still be pursued.
There were media reports four months ago indicating that Cajee had withdrawn the assault charges, but that the National Prosecuting Authority had insisted on continuing with the case.
The Hawks have confirmed that Schultz was under investigation for other crimes.
