Former Rustenburg mayor Matthew Wolmarans and Enoch Mtshaba should be jailed for life for killing councillor Moss Phakoe, the Rustenburg High Court heard on Tuesday.

State advocate Rapula Molefe said the minimum sentence for pre-meditated murder was life.

“The minimum sentence is life and if the court does not hand down a custodial sentence the public will not have confidence in the court.”

The attack on Phakoe was brutal and horrible. He was a whistle-blower and a law-abiding citizen, said Molefe.

The accused had not shown remorse, and there were no substantial circumstances to mitigate for a lesser sentence.

Wolmarans, through his lawyer, asked for a lenient sentence, stating that he did not pull the trigger.

Mtshaba told the court through his lawyer that he was diabetic and had a child to support.

Molefe called for the court to consider the fact that the murder was pre-meditated, “well calculated and planned”.

Judge Ronnie Hendricks was expected to hand down sentence later in the day. – Sapa
