Durban - A man charged with murder following an altercation on a Pietermaritzburg road, failed to turn up in court again on Tuesday after allegedly falling off his bicycle and suffering concussion.

Ian Williams, 38, is alleged to have shot Tyron Terry dead a day after an argument related to an alleged road rage incident.

Williams’s trial was scheduled to begin on Monday, but Williams, who is out on bail, did not pitch up at court because of an alleged medical condition.

Judge Mahendra Chetty then issued a warrant of arrest for Williams, and ordered that medical certification be submitted to justify his absence.

On Tursday, the court was handed a medical certificate from Dr K Reddy, at Daymed Hospital in Raisethorpe, stating that Williams was “unfit for legal proceedings” following a bicycle accident.

The certificate states that Williams collapsed after riding his bicycle and hitting his head on concrete.

“There was loss of consciousness on the scene. Williams has been admitted to hospital for observation and is currently unfit for legal proceedings,” the certificate reads.

Judge Chetty adjourned the matter to Wednesday, saying he needed more information.

Williams is alleged to have sought Terry, 27, out after an altercation on Mthomhoti Road in Imbali in March 2012.

It is alleged that the two had been driving when Williams changed lanes and swerved in front of Terry. The two got out of their cars and a heated argument ensued, after which both men went their separate ways.

The next day, Williams spotted Terry’s car parked in a yard in Imbali. He approached Terry and shot him in the head.
