Magistrate lashes assault accused

Komatipoort - An Mpumalanga magistrate has told a man accused of assaulting his 71-year-old mother he should stay in the holding cells with men of his kind.

Thulani Khoza, 28, of Steenbok village near the Mozambican and Swaziland borders, was not asked to plead to charges of contravening a protection order and assault with intent to cause grievous bodily harm when he appeared in the Tonga Magistrate's Court on Tuesday.

Khoza was arrested on December 30, 2013, for assault after his mother obtained a protection order against him, a Sapa correspondent reported. He was granted R1000 bail, but told magistrate Sibonisiwe Sibuyi he could not afford it.

He pleaded with her to release him on a warning because he was being beaten in police holding cells.

“Khoza, face the truth in custody and see what other men like you are capable of,” Sibuyi said.

Sibuyi said Khoza should feel free to appeal the bail amount imposed. If he had difficulty paying the bail amount, he could go to the clerk of the court within 14 working days to appeal, she said.
