Pietermaritzburg - KwaZulu-Natal co-operative governance MEC Nomusa Dube has petitioned the Pietermaritzburg High Court to nullify the appointment of an AbaQulusi municipal manager.
She said on Wednesday the appointment was flawed.
“We are taking this extraordinary step of requesting the court to set aside the purported appointment of the new AbaQulusi municipality municipal manager and the unlawful meeting which approved the appointment as a matter of principle,” Dube said in a statement.
“We are concerned that this may set a wrong precedent that it is permissible for candidates to misrepresent themselves in senior municipal positions as a way of gaining unfair advantage over other candidates.”
Dube said Vusumuzi Mthembu had misled the council by claiming, among other things, that he had lectured at the University of KwaZulu-Natal, which was not true.
The meeting where Mthembu was appointed was hastily convened and chaired by the deputy mayor in the presence of the mayor, which was a serious violation of local government prescripts, Dube said.
“It is our commitment as the provincial democratic government to promote good and clean governance at local government level.
“In keeping with this commitment, we will ensure that proper processes are followed and that candidates provide correct information during the application processes,” Dube said.
The municipality could not be reached for comment.
In an earlier report by the SABC, the municipality said it stood by its decision to employ Mthembu.
