Oscar faces premeditated murder charge

Pretoria - Olympic hero Oscar Pistorius has to show exceptional circumstances to be released on bail.

This follows Chief Magistrate Desmond Nair ruling that for the purpose of bail Pistorius is indeed facing a premeditated murder charge.

Nair said he ruled the offence to be a schedule 6 as he could not rule out the possibility of premeditation.
 

As his words echoed through the overfull courtroom, gasps could be heard and Pistorius once again sobbed in his hands.

Nair then left the dock glaring at photographers who were firing away with their cameras.
 

Pistorius’ family huddled together, exchanging hugs.


Earlier State prosecutor Gerrie Nel argued that last Thursday’s shooting was not in the spur of the moment and therefore premeditated.

Nel told the court Pistorius and Reeva were the only two people in his R4 million house in the Silver Woods Estate on the morning of the shooting.

He argued that it was impossible for Pistorius to not have known it was Reeva behind the locked bathroom door.

"She locked the door for a reason. It must have been horrific being fired at in such a small confined space," Nel said.

The State argued that Pistorius put on his prosthetics, armed himself, walked seven metres to the bathroom and fired four shots.

Barry Roux SC for Pistorius said they were convinced "it was not even murder”.

He told the court that Pistorius wanted to take the court into his confidence and will tell the court every detail of that night via an affidavit.

Pistorius broke down several times in the dock, covering his face with his hands.

He is neatly dressed in black suit and tie and a light blue shirt.
