Durban - After fighting for his life in hospital for more than three weeks, a man who was shot, allegedly by a policeman in a road-rage incident in Pietermaritzburg, died on Saturday.

Kavlin Naidoo, 27, had been shot in the stomach on November 2.

His family has instructed attorney Suren Singh to institute legal action against the MEC for Safety and Security and the policeman for damages suffered, including by Naidoo’s brother Davelin and girlfriend San-dhani Padayachee, who had witnessed the shooting.

“He fought so hard to stay alive… although he could not talk, when I spoke to him on Thursday I saw in his eyes that he knew what I was saying,” his mother, Patsy Naidoo, said between sobs on Sunday.

Sergeant Thobelani Khuzwayo, 35, was charged with attempted murder. He is out on R2 000 bail.

It was alleged that Khuzwayo sped past a vehicle in which Naidoo was a passenger in the city centre and stopped, blocking their way. Naidoo got out of the car to ask what was happening and Khuzwayo allegedly took out his state gun and shot him before driving off.

Davelin had been driving him and Padayachee.

It was believed that Khuzwayo was driving a state vehicle at the time and was off duty.
