Cape Town - Disturbing details emerged in the bail application of Dr Oluwabusuyi Babalola, who allegedly raped a patient at the Nyanga community clinic last month.

Besides the most recent charge of rape, the State on Tuesday confirmed Babalola had also been charged with two more counts of rape where the same modus operandi was allegedly used.

In an affidavit before court, Babalola said he would plead not guilty to the charges.

Investigating officer Warrant Officer Adam Kappes told the court the State would be able to prove its case, and went on to share details that evoked gasps from the public gallery.

Kappes said in all three incidents of rape, the accused allegedly used a similar approach on his victims.

He said the survivor in the most recent rape accusation had visited the clinic complaining about backache and was referred to Babalola, who had been working at the clinic with an expired licence.

Health Professions Council of SA (HPCSA) spokeswoman Priscilla Sekhonyana confirmed Babalola’s practitioner’s registration expired on March 31.

“The complainant went to the Nyanga clinic on September 26 complaining of a backache. The doctor then asked if she had abdominal pains and if it hurt when she had sex,” the investigating officer said.

The State alleges Babalola then instructed the complainant to undress and lie on the edge of the clinic bed.

“He (Babalola) then put some gloves on and proceeded to put gel on his hands before telling the complainant to relax.”

Kappes went into graphic detail about how Babalola then allegedly inserted his fingers into the complainant’s vagina before allegedly raping her.

Earlier, Kappes, who testified for the State in opposing bail, took the stand after an argument between the prosecutor and the defence lawyer over which schedule the bail hearing would fall under.

Magistrate Goolam Bawa later ruled the matter would proceed as a Schedule 6 bail application, placing the onus on the accused to convince the court why it would be in the interest of justice for him to be released on bail.

Kappes will continue giving evidence on Friday.
