Sheriff unsuccessful in serving Mdluli

Johannesburg - A deputy sheriff of the court unsuccessfully tried to serve legal papers on former crime intelligence boss Lieutenant General Richard Mdluli on Wednesday.

In a notice to the court, Happy Thantsha said he twice tried to serve the papers, from non-profit organisation Freedom Under Law (FUL), to Mdluli at his home in Boksburg, but was turned away.

“I arrived and was ordered by a female on the intercom, that no person was allowed to enter the premises and no documents must be accepted for any reason,” he told the court.

“Once again an attempt was made... and the bodyguards (at the house) refused to supply their names or allow me entry to the premises. They also refused to accept service of the documents.”

FUL applied for an urgent interdict on Tuesday preventing Mdluli from serving in the police.

It also applied for an interdict against Police Minister Nathi Mthethwa, to prevent him from moving Mdluli to a new position before a review of his reinstatement.

Mthethwa's office said he received the legal papers on Wednesday.

“We can confirm that we received the court papers and that our legal team are currently studying them,” his spokesperson Zweli Mnisi said.

The urgent application would be heard in the Pretoria High Court on June 5.

Mthethwa announced on May 9 that Mdluli would be shifted from his position to another division in the police.

Last year, Mdluli faced fraud and corruption charges relating to alleged misuse of a crime intelligence fund, the purchase of luxury vehicles and the hiring of family members. He also faced a murder charge following the murder of a former lover's boyfriend, Oupa Ramogibe.

Both sets of charges were withdrawn and Mdluli was reinstated as head of crime intelligence.
