Swingers party murder pair in court

Durban - A Phoenix woman who, with her husband, has been charged with murdering a Redhill man and attempting to murder his wife at a “swingers party” gone bad, said she had been the victim of intimidation.

When the pair appeared in the Durban Magistrate’s Court on Monday, their attorney, Bob Bahadur, said the deceased’s father had been “interfering” with his client.

He asked the court to warn the man, but magistrate Vanitha Armu refused, saying if the woman was being interfered with, she should approach police.

According to court documents, the accused were at the home of the Redhill couple on Heritage Day, when an argument broke out. The host couple were stabbed. He died and she was hospitalised.

Last month, the Daily News’ssister paper, Post, reported that the couples had met via a local online classifieds network which facilitated “couples seeking couples” and “swingers”.

The visitors handed themselves to authorities and appeared before Armu in September. They were released on bail of R3 000 each and the matter was postponed for further investigations.

On Monday, the court heard that evidence – understood to include a post-mortem report and DNA results – was still outstanding and the matter was again postponed.

Bahadur said he was aware DNA results took between two and three months to process and asked for a lengthy postponement, with a view to having it marked final. Armu refused, but said she would reassess the matter when it next came before her.

The pair were expected back in court early next year.

In September, the court noted claims that the accused were assaulted by police while in custody.

According to these claims, the accused were separated, bound with rope and had plastic bags placed over their heads. The Phoenix man said he was assaulted with pins and his wife slapped in the face.

Bahadur said a case had been filed and the matter handed to the Independent Police Investigative Directorate (Ipid).

Ipid spokesman Moses Dlamini was unavailable for comment on Monday.
