Tensions flare in beard murder case

Krugersdorp - Tensions flared in the Krugersdorp Magistrate's Court on Thursday in the bail application of Roedolf Viviers, who is accused of the murder of a Muslim man.

Muhammad Fayaaz Kazi's family and friends reacted angrily when the court was told there would be no public outcry if Viviers was granted bail.

Viviers' lawyer Hendrick Nortjie, who was being cross-examined, said he had not seen any protests or marches about the incident.

“It's an interest, not a public outcry,” he said.

During a short adjournment, members of Kazi's family voiced their fury.

“They want a public outcry, we will show them a public outcry,” they said. “We have been quiet for too long and if the law doesn't take its course, we will.”

Kazi's father-in-law Hashim Motara broke down in tears and asked: “They say he should be let go because his mother is ill.... What about a mother that lost her son?”

“We know where they stay..,” he said.

A few minutes later, they returned to the courtroom holding placards. “No bail,” read one of them. “Justice delayed is justice denied”, read another.

Viviers and another man, Zayne van Tonder, 33, allegedly made racist remarks to Kazi and his friend Anser Mahmood about their beards, at a Chicken Licken outlet in Magaliesburg on August 6, 2012.

An argument and a fight ensued. Kazi was severely beaten and died in hospital.

Charges against Van Tonder were later dropped and he was released. - Sapa
