Traffic cop wants case withdrawn

Written representations will be submitted for the withdrawal of a murder charge against Cape Town traffic officer Ian Sinclair, the Wynberg Magistrate's Court heard on Wednesday.

Sinclair is alleged to have shot dead former Western Province cricketer Luke Fairweather at the Newlands Cricket Grounds in January.

Fairweather apparently confronted him over a traffic ticket issued to Fairweather's mother.

Sinclair, 59, neatly dressed in a dark suit and accompanied by his wife, made his fifth court appearance on Wednesday, before magistrate Marieka van Eeden.

He was told to return to court again on September 27.

Sinclair is to go on trial in the Wynberg Regional Court, if his representations to the Western Cape Directorate for Public Prosecutions for the withdrawal of the charge fail.

At his next court appearance, Sinclair's case is likely to be transferred from the Magistrate's Court to the Regional Court, and Sinclair will then be informed when to appear in the Regional Court.

Although the proceedings have progressed to the stage of trial, defence attorney John Riley told the court on Wednesday that Sinclair had instructed him to make representations for the withdrawal of the charge.

At his bail hearing in January, Sinclair told the court he had been in the employ of the City of Cape Town for 34 years, and was now a senior traffic officer.

He said he had been married for 16 years, and that his entire life had been focused on his career as a traffic officer and his involvement in law enforcement.

His R1000 bail was extended. – Sapa
