Two in court after teen beaten to death

Nerlspruit - Two men accused of beating a schoolboy to death appeared in the Nelspruit Regional Court on Tuesday.

Magistrate André Geldenhuys postponed the case to January 27, with both men out on R1000 bail, a Sapa correspondent reported.

Mfaniseni Sammy Kubhayi, 30, and Dumisani Sydwell Mashaba, 26, both from Mahushu near Hazyview, were arrested in February 2009

following the murder of Dominic Maminza, 16, from Bhekiswayo.

The court heard that Maminza was kidnapped from his home around 10am on February 10, 2009, after he was accused of stealing Kubhayi's mother's handbag.

The two allegedly tied Maminza up and a group of people attacked him with their bare hands and sjamboks. He died from his injuries in hospital on February 17.

State prosecutor Simon Mamabolo said the evidence from Kubhayi's mother and Maminza's grandfather, Wilson Maminza, indicated Kubhayi and Mashaba assaulted the boy.

“On evidence from your mother, you assaulted the deceased with open hands in front of her, when she questioned him about her missing handbag,” Mamabolo told Kubhayi.

“The deceased's grandfather, Maminza, also testified that on February 11, he found the deceased kept inside a room and tied up with ropes. When he went to question your mother in a separate room why he was held there, you came and went to assault him again in the other room.”

Kubhayi replied: “(Wilson) Maminza is lying. I was not there on the 11th (of February). My mother also made a mistake by implicating me in this matter. I know nothing about the murder,” he said.
