'We had consensual sex'

The 15-year-old Jules High School girl, who accused her schoolmates of raping her, has dropped her claim in the Johannesburg Magistrate’s Court.

The girl made her second brief appearance in the Magistrate’s Court on Thursday morning and admitted, for the first time, that she had consensual sex with the two boys aged 14 and 16.

On Wednesday, the girl, and the two boys were charged with statutory rape by the national director of public prosecutions Advocate Menzi Simelane. Simelane’s decision comes after the State, based on the evidence, was unable to prosecute the boys on the main count of rape, and followed consultation with the prosecution team, which had conducted interviews with the girl and other possible witnesses last week.

The team, according to Simelane, dismissed the claim of rape and recommended statutory rape charges against the three, citing consensual sex while underage.

During their first appearance, the boys admitted their role in the consensual and their matter was postponed until December 1. They are due to be placed on a diversion programme. The girl maintained, at the time, that she was still a victim of rape.

However, she changed her mind on Thursday morning, and agreed that the sex was consensual.

She would now also be placed on a diversion programme along with the boys she accused of rape.
