The 15-year-old Jules High School girl, who accused her schoolmates of raping her, has dropped her claim in the Johannesburg Magistrate’s Court.
The girl made her second brief appearance in the Magistrate’s Court on Thursday morning and admitted, for the first time, that she had consensual sex with the two boys aged 14 and 16.
On Wednesday, the girl, and the two boys were charged with statutory rape by the national director of public prosecutions Advocate Menzi Simelane. Simelane’s decision comes after the State, based on the evidence, was unable to prosecute the boys on the main count of rape, and followed consultation with the prosecution team, which had conducted interviews with the girl and other possible witnesses last week.
The team, according to Simelane, dismissed the claim of rape and recommended statutory rape charges against the three, citing consensual sex while underage.
During their first appearance, the boys admitted their role in the consensual and their matter was postponed until December 1. They are due to be placed on a diversion programme. The girl maintained, at the time, that she was still a victim of rape.
However, she changed her mind on Thursday morning, and agreed that the sex was consensual.
She would now also be placed on a diversion programme along with the boys she accused of rape.
Her case was also postponed until December 1 for a final order. - Read the full story in The Star

At the end of the day the girl alone can't be victimised, both parties should have known and know the difference between rite and wrong.Firstly what the hell is alcohol doing on school premises, secondly weren't these kids supposed to be in class learning, whether they had sex or not but this is not supposed to be happening at a school. All the people blaming her only and judging her i think is a bit ridiculous when all three of them including the fools that recorded the video as well as the teachers should be held responsible for the entire ordeal.

Good gracious, what has our country come too?? All this screams lack of parental guidance as children are left to be brought up by television and see the results. There is so much rubbish going on our TV lately even our local soapies trivialise sex and make those who indulge seem like heroes. Parents take a grip on your childrens life or our country is doomed

Agreed that the people responsible need to be charged and punished but the problem is that schools are no longer places of learning and are no longer respected by kids. Are these kids going to be suspended for their actions? For bringing the school's name into disrepute? For being charged in a criminal court? No, they will be allowed back into school to continue with their studies in no time. So what are they really learning? Discipline in schools is a joke, kids can ignore the consequences and the government is reluctant to remove problem kids from schools. The net result is the kids do what they like and the teachers are helpless to prevent this. The situation is only good in schools where the parents and surrounding society respect the school and adhere to the codes of conduct. At this school it looks like no cares at all. Its no surprise this happened then.

Parents must keep a close eye on their teenagers! I am sure if parents would search their kids school bags and bedrooms, there's a lot they would find, so please lets not blame the school and the teachers first.

Obviously they are all three guilty and the parents and teachers involved should crawl under something for failing these children. Whether the sex is consensual or not, were none of the 3 aware that having sex at school is not the done thing? Where are the teachers when teenagers are bonking and drinking on the school grounds?

What's the bet this "little girl" has been sexually active for a long time. Just watching the news clips of the behaviour of some of these "little" girls outside the school gates, shows how they blatantly throw themselves at the boys. They should be expelled as they are obviously far to "grown-up" to be at school. Stop making excuses for them...they knew exactly what they were doing! And if she falls pregnant, no problem, the taxpayers will have to fork out for another child grant or carry the burden if they develope AIDS. NPA should still charge them...the time wasted on this could have been used to solve a genuine rape case.

Is there no stimulating and educational hobbies for youngsters nowadays except for sex?. SA kids are setting the stage for disaster. All schoolkids thinking of sex all the time that there is no time to think of self-improvement or self-development. Will SA produce Engineers, Surgeons, and Scientists of quality in the future?. I think not. The greatest resource any country has are its people. So because of the preoccupation with sex in our schools, we are going to fall far behind in world-rankings in a few years from now.

This poor girl has just cried wolf. The next time (and sadly there may be one) a school girl is really raped, the public will remember this case and wonder if she is actually telling the truth.

This is totally irrational sentencing young teens for consensual sex. These kids need help

This girl is sick, she needs help. It is an extreme manifestation of low self esteem and tries to attach herselsf to boys in order to win their favours. Perhaps this girl does not have a father and this is a cry for help for this missing father figure.God help us

only 1 question's stuck in my mind...where the hell were the teachers? the ones who are supposed to be looking after those kids when they are at school, isn't school the one place where u expect ur kids to be safe when they're not at home? rape or not, that shouldn't have happened at school during school hours
