Johannesburg - The Commission for Conciliation, Mediation and Arbitration said the matter between the South African Revenue Services (SARS) and suspended deputy commissioner, Ivan Pillay, had been settled as a result of a “successful” conciliation process.

But lawyers for Pillay would not confirm the outcome of the CCMA-process including the terms to the agreement.

Last year Labour Court Judge, Annelie Basson, referred the question of whether Pillay’s suspension was fair to the CCMA.

She ruled that his suspension was unlawful.

Last year Sars Commissioner, Tom Moyane, suspended Pillay and group executive for strategic planning and risk, Peter Richer, on allegations that a special investigations unit they oversaw “may” have included “rogue behaviour that had the potential to damage the reputation of SARS as an organ of state”.

The suspensions followed the findings of a panel led by Advocate Muzi Sikhakhane into allegations reported in the media about the unit.

The stories, published by the Sunday Times, said the unit operated a brothel, and may have carried out clandestine investigations into the tax affairs of politicians and other connected individuals.

Neither Sars spokesman, Adrian Lackay, nor Sars’ lawyer could be reached for comment at the time of publication.
