Winnie Madikizela-Mandela has blamed President Jacob Zuma for the disciplinary charges against Julius Malema.

Madikizela-Mandela said on Wednesday the decision to charge the ANC Youth League leader was Zuma’s. She was giving evidence at the hearing at Rand Stadium in Turffontein.

The prosecution team has not listed Zuma or ANC secretary-general Gwede Mantashe as complainants. Mantashe testified against Malema while Zuma elected Lindiwe Zulu to testify on his behalf.

The ANC disciplinary hearing against Malema followed utterances he has made since May this year which the prosecution asserts are “unbecoming of an ANC member”.

In one of the charges the ANC prosecution team, led by Andries Nel, alleged that Malema was guilty of contravening Rule 25.5 (d) of the ANC constitution by sowing racism and political intolerance.

Nel alleged that Malema had undermined the ANC constitution, when on May 9 during an ANC rally in Galeshewe, Kimberley, he made the following remarks: “They (whites) have turned our land into game farms… The willing buyer, willing seller (system) has failed.”

In her testimony, Madikizela-Mandela found nothing wrong in his utterances, maintaining that the struggle against apartheid was about land.

In his defence, Malema justified the comments. He said the market-based “willing buyer, willing seller’ principle for land “was responsible for the slow pace in land reform”.

He also said that ”10 years into democracy only about 3 percent of agricultural land had been transferred through the land reform programme”.

Malema also asked Nel to read ANC stalwart Govan Mbeki’s paper on The Peasants Revolt, published in 1964.

“In the early 1990s,” Malema argued, “after the unbanning of the liberation movements, the World Bank convinced the ANC that 30 percent of commercial farm land in the former white areas could be transferred to 600 000 smallholders through a market-led programme of land redistribution. But this has turned out to be much more difficult than anticipated.”

Malema maintained that nationalisation of land was a lasting solution.

@iwanele yes the apartheid (as a system) is over but the practices and the atmosphere is not. S.A will forever remain a colour nation, the 'rainbow nation' concept is a myth...and economy wise, the blacks are cathcing up and the whites are keeping up. Its far more easier to keep up than it is to catch up. And could somebody tell me as to why do white people-out of the blue always have to be on smiling sprees whenever they meet up with a black person in the lifts, corridors, or passages? I find it very phony...

Winnie obviously did as badly in school as the Jelly Tsotsi, or she is ignoring history to further her own agenda. Every single square meter of SA today has been taken in battle; this tribe took it from that one, that one took it from this one, etc, etc. The only people that can say they were the original citizens of Sa is the Bushman and the Stransloper. Everybody else is a immigrant, and that includes ALL the black tribes, whose own history says they 'came from the north'. If black people want land today, ask the govt, they have millions of hectares. But no, what Winnie and Fatboy want is a functioning wine or game farm, right?

.... ummm - I see that nothing is said of the farm that have been expropriated and that are lying fallow - hundreds of them. Productive farms that have been taken and are now rotting, homesteads vandalised and useless, farm implements rusting. What about that? Malema himself owns farms so what is he whining about. Farming is not for cissies. We need farms that produce crops to feed the country and there are many people of colour who have the will and the skills so why, please tell me, are these hundreds (maybe even thousands) of farms rotting?

I agree with xhanti that there is little constructive debate going on here or in any of the comments on other related articles . A great pity! I am personally very concerned about the levels of poverty and disempowerment in the country. In my opinion apartheid was a breeding ground for the development of some very negative traits amongst all South Africans. Whites and blacks who are in strong financial positions don't seem to think that they need to do more to help. And it would appear that many poor people in the country don't see the importance of trying to help themselves too. As a white however, what really worries me is the apparent distrust of whites by blacks. Why else would the DA have been ignored and the ANC having received such overwhelming support in the last elections. I believe that we should all contribute more where we can. If we get out there and break down barriers (not just donating money to charities) then we will move in the right direction. There will be less space for the type of rhetoric used by Malema and his ilk to be heard as people will know from personal experience that he is speaking nonsense and is opportunistic.

Thinking with my brains and not my hear, I think Malema has a point. No media ever wrote about land redistribution process failures, unless it is not supposed to happen or are we turning a blind eye. This willing buyer, willing seller thing does not work, period. We all know it. Do we not see ?
