The case against a taxi driver charged with killing 15 passengers in an accident in Allandale, KwaZulu-Natal, was postponed by the Pietermaritzburg Magistrates's Court on Thursday.
Khululeka Gwala will hear if his bail application was successful on November 15.
Gwala's attorney, Anthony Irons, told the court his client should be granted bail as he was not a flight risk.
He also indicated that Gwala would argue that the accident was out of Gwala's control as the brakes on the minibus were faulty.
Prosecutor Rene Padayachee said community members were angry about the lives lost in the accident.
She said the state should not be held responsible if the community decided to take the law into their own hands.
Gwala faces charges of murder, attempted murder and reckless and negligent driving.
A total of 15 passengers were killed when Gwala tried to overtake cars in peak hour traffic in September.
