Rightwinger Willem Ratte did not apply for bail when he appeared in the Witbank Magistrate's Court on Friday and is still on hunger strike, his lawyer Daan Mostert said.
“Willem is still in jail,” said Mostert. “He still doesn't want to apply for bail.”
Ratte and one fellow-accused would remain in custody, while the remaining eight were granted bail, Mostert said.
He could not immediately provide details on why the other person was not released.
They are all expected to return to court on November 30.
The group were arrested during a police raid on Ratte's farm in Balmoral, Mpumalanga, in September.
An urgent application in the High Court in Pretoria for their release failed.
The preliminary charges are possession of dagga and unlicensed firearms.
Ratte earlier indicated that he would not apply for bail to show that he was “not happy” with the way the State had acted in the case. -
