Rath 'misrepresenting himself' - DA

The Democratic Alliance is confident the police will thoroughly investigate the charge of fraud they have laid against controversial vitamin entrepreneur Matthias Rath.

On Friday the party laid criminal charges against Rath for "misrepresenting himself as a doctor".

DA health spokesperson Mike Waters said they had "total faith in the judicial system and they were confident that the police would investigate the matter".

Waters charged Rath was misleading people to believe he was qualified to offer medical advice on the treatment of HIV and Aids.

Rath has been met with controversy over his remedies in several countries and is embroiled in a Cape High Court battle with Aids activist group the Treatment Action Campaign.

Waters laid charges against Rath at the Cape Town Central police station following a visit earlier this month by the DA to the Cape Town offices of the Matthias Rath Health Foundation.

The DA said in its affidavit that Rath's foundation offers from its premises advice on treating Aids, along with products it says can reverse the course of the disease.

Although Rath was not a registered health professional in South Africa, he distributed pamphlets from his office which refer to him as Dr Rath.

"He offers medical advice in these pamphlets using quasi-scientific language and diagrams, and deliberately creates the impression that he is an authoritative medical practitioner.

"His pamphlets contain photographs of him with groups of other healthy-looking people, with captions claiming these people to be 'Aids patients living a normal life again as a result of a nutrient programme'," the DA said.

Waters said the Health Professions Act states that anyone representing themselves as a doctor, using the name of a medical practitioner, or any title or symbol creating the impression that they hold a medical qualification, or are registered as a medical practitioner in South Africa, "shall be guilty of an offence".

When the renewed controversy broke earlier this month, Rath's lawyers responded in newspaper reports that Rath called himself Dr Rath on the basis of his PhD doctorate.
