Teko Modise in action for Sundowns.

Fottballer Teko Modise has dribbled his way out of a possible jail stint, reaching an out-of-court settlement with his estranged wife this week.

Court papers filed in the Johannesburg High Court indicated the Mamelodi Sundowns captain was in arrears of R52 000 after failing to honour a monthly maintenance order of R31 000 to his wife Ntswaki Felicia Modise.

Ntswaki, 26, went the legal route after Modise defied a February order by Judge Caroline Nicholls which instructed him to make monthly maintenance payments of R31 000 towards his wife and two-year-old daughter’s upkeep, and a further R15 000 towards Ntswaki’s legal costs. The Bafana-Bafana star was also ordered to give Ntswaki one of his cars – a BMW X6, BMW M3 or a BMW 1 Series.

Ntswaki wanted Modise to be held in contempt of court and locked up. Modise had until yesterday to contest the contempt of court application but the couple have since reached an out-of-court settlement.

“They have settled and we are not proceeding with the application. It (the matter) was settled yesterday (Thursday),” said Ntswaki’s attorney Caroline de Villers yesterday.

She could not be drawn into discussing details of the settlement which is likely to be made an order of court in the last week of the month – a date which had been set down for the hearing had Modise filed papers instead of settling.

Ntswaki launched the Rule 43 application in November after Modise allegedly deregistered their daughter from his medical aid and refused to give her money after allegedly kicking out mother and daughter from their R1.85 million home last year.
