SUBSCRIBERS to pay channel TopTV will have to wait until January 31 to find out if they can view pornography 24 hours a day on the station’s three proposed adult channels.
The satellite TV newcomer had planned to launch the three channels – Adult XXX, Playboy Europe and Private Spice – this Friday after applying to the Independent Communications Authority of SA (Icasa) in September.
But the Johannesburg High Court yesterday interdicted the station from launching the channels without authority from Icasa.
Icasa had brought the urgent application on Friday. Icasa spokesman Paseka Maleka said they brought the application to stop the station from launching the channels until the public consultation processes are complete.
Twelve oral submissions were heard yesterday. A submission from the Freedom of Expression Institute (FXI) still has to be heard, before a final decision is made on January 31.
The submissions heard yesterday were from a combination of individuals and NGOs, including presentations from the Film and Publications Board and the Christian Action Network. The FXI was to make a final argument today.
Film and Publications Board spokesman Mlimandlela Ndamase said the basis of their submission was that according to the Film and Publications Act, it is illegal to broadcast such content on TV. The act stipulates that the distribution of adult content can be done only through licensed stores and classified videos, and the sale of this content could only be to people over the age of 18.
FXI executive director Elston Seppie said that if these channels were allowed, the station would have to focus on the rights of women and children.
“We don’t have a level of censorship, but we need to consider the impact these channels would have on women and children,” said Seppie.
TopTV’s sales and marketing vice-president, Marius Liebenberg, said the adult channels would be carefully managed – available as a distinct stand-alone package with its own subscription and an additional subscription fee of R199 a month.
He said public opinion and independent research that TopTV had commissioned showed 71 percent of urban adult South Africans agreed that people had the right to view material of their choice, including adult content, in the privacy of their homes.

Then you might aswell sleep with your spouse in the living room in broad day light in the presence of your kids. "Just walk the streets of joburg sometime" again sinethemba here we're talking about our homes...And my kids and I don't walk the streets of Jo'burg coz as I've indicated it's my responsibility to care about what my kids are exposed to.if you so desperstely want to watch strangers engage in sexual acts, Go rent the porn movie from the 'streets of Jo'burg' and insert it in your dvd player and watch in your own privacy then remove it. reason I'm not interested in porn is because after watching it. Thank God you don't live in my house.

We do not leave in a nanny state.People who want the channel will have have to subscribe for it. You worry about the children, you must be kidding. Porn is available at the click of the button on cellular phones. This TV subion will mean those who dnt want their kids to watch can block the channel, you cant do that on a cellphone. Just walk the streets of joburg sometime. Porn DVDs are available at ten rand a pop. All this hullabaloo, is from a bunch of people who want to be moral dictators. If ICASA disallows this, I'd think we arent that different to Islamic states who monitor the thinking of their citizens.

I know I am just one voice but I'm sure I'm one voice of many...why do we need a porn channel on our TV screens? Whoever wants porn must go rent it or by it from wherever they buy them,So many children are being raped already by these sexual preditors who live among us, imagine now if they've got porn at the click of their their finger,they shouldn't be encouraged like that. I just don't see the need,what is the need for it?...the courts need to consider the safety of our kids and feelings of many parents out there...we already have so much to deal with, the TV plays enough explicit content and the parent has to observe what the child is exposed to on top of our daily responsibilities,there shouldn't be another responsibility dumped on our shoulders again. it's enough.
