Expelled Agang MP Michael Tshishonga's urgent court application against the party's president Andries Tlouamma was dismissed by the High Court in Johannesburg , the party said.
The decision to strike Tshishonga's application off the roll, with costs, was made , parliamentary spokesman Aubrey Plaatjies said in a statement.
Tshishonga had approached the court in an effort to compel the party to allow him to have an equal say in its leadership, despite the fact that he had been expelled, Plaatjies said.
“We hope that he will now accept his fate. This is actually a very sad occasion for us. An individual can never be more important than the party,” he said.
Tshishonga was expelled on February 28 after he failed to attend a two-day disciplinary hearing.
“He did not pitch on the first day in Pretoria. He was given a second chance to attend another hearing in Cape Town the following day and he did not pitch there as well,” Plaatjies said.
Agang SA's elected members then took a decision to withdraw his membership in the party as well as in the National Assembly.
Plaatjies said the judge had found Tshishonga's court application “grossly abusive”.
Tloumma hoped the ruling would deter Tshishonga from further “pointless litigation”.
Business Day reported on March 13 that Tshishonga had allegedly misappropriated R80,000 of party funds, according to Tlouamma who was speaking at a press conference.
Tlouamma also said Tshishonga had attended very few sessions since the party had entered Parliament in June last year. Communications between the two had reportedly broken down.
