Durban - An application was to be made for the discharge of former policeman and murder accused, Brian Treasurer, on Thursday.

Defence advocate Bob Bahadur indicated this after the state closed its case against Treasurer and his co-accused, Mfaniseni Nxumalo, who are on trial for the murder of prominent Pietermaritzburg doctor, Bhavish Sewram, 33.

Bahadur confirmed he would be making the application for discharge before Pietermaritzburg High Court Judge Anton van Zyl this morning.

Sewram, a father of two young daughters, was gunned down outside his Chota Motala Road surgery on May 13, 2013.

The trial of a third accused, KZN businessman Rajive Soni, was separated from that of Treasurer and Nxumalo.

A fourth accused, Sabelo Dlamini, pleaded guilty to being the triggerman who shot dead Sewram.

The State alleges that Soni enlisted Treasurer’s help in hiring Nxumalo and Dlamini to kill Sewram.

It is alleged that the motive for the murder was Soni’s belief that Sewram was having an affair with his wife.

Dlamini was the star witness in the state’s case against Treasurer and Nxumalo, and testified that Treasurer had driven them to Sewram’s surgery on the night of the murder, and provided him with the firearm.

He told the court that Treasurer had described Sewram to him in detail before the shooting, and had given him R12 000 in cash for committing the murder.
