EFF stadium case struck off roll

Pretoria - A dispute between the EFF and the City of Tshwane over the use of a stadium appears to have been resolved, the High Court in Pretoria said on Tuesday.

It removed from the court roll an urgent application by Julius Malema's Economic Freedom Fighters on the matter.

Malema had sought to compel the City to honour an agreement about the use of a sports stadium in Atteridgeville for a planned political rally.

Judge Sulet Potterill removed the EFF's application by agreement between the parties, saying it appeared that the dispute between them had gone away.

The EFF took the council to court after it cancelled an agreement concluded with the EFF on April 23 for the hiring of the Lucas Moripe stadium in Atteridgeville for the EFF's rally on May 3 and 4.

The party said in court papers it had already spent R5 million on the rally when the agreement was unilaterally cancelled.

The city's executive director for sport and recreation services, Ngwako Tshwale, said in court papers the city had acted within its rights when it cancelled the lease.

But he added that the cancellation had subsequently been abandoned.

He said the application was premature as the EFF still had to submit its presentation to the Joint Operational Committee on April 30.
