Durban - A 77-year-old grandfather was handed a three-year suspended sentence by the Pietermaritzburg Regional Court on Tuesday for being in possession of child pornography.

Anthony Moyes had entered into a plea-agreement with the State in which he admitted that from 2008 to last year, and while at home, he accessed 331 images from the internet that depicted child pornography.

He saved the content, which included teenagers under the age of 18, on his computer. Moyes admitted that his conduct was unlawful and intentional.

Suffering from impotency that medication could not cure, he attempted to treat his condition by resorting to possessing and viewing the images.

The plea said he was in the process of a divorce and was a pensioner.

His being in possession of the pornography had not injured or affected anyone, he was a first-time offender and he accepted that his actions caused lasting harm to his relationships with family members.

Moyes also accepted that his actions caused him marital problems, public shame and a fall from grace.

He did not pose a danger to children.

Moyes acknowledged his responsibility to rehabilitate himself and undertook to desist from accessing pornography of any nature.
