Johannesburg - Lolly Jackson’s alleged killer George Louca will apply on Tuesday to be released from prison to live out the last days of his life in Cyprus.

Louca was diagnosed with stage 4 terminal lung cancer last month, after he was rushed to a hospital in February due to a serious chest infection sustained while in prison.

A Section 49E application that the director of the prison in which the Cypriot is currently being held has filed could allow Louca to be released to receive appropriate medical health care in his final days.

The application, also known as the Protocol on Referral of Terminally Ill or Severely Incapacitated Remand Detainees to Court in the Correctional Services Act, can allow an early release from prison if the facility cannot provide adequate health care for the awaiting trial prisoner.

It emerged on Monday that Judge Geraldine Borchers would preside over the application in the high court sitting in Palm Ridge on Tuessday morning.

Louca’s lawyer Owen Blumberg said all of the necessary arrangements had been made to ensure Louca is returned to Cyprus for top medical care should the application be successful.

It is understood, however, that State prosecutor Paul Schutte will oppose the application.

Jackson, the owner of strip franchise Teazers, was gunned down at a house in Ekurhuleni in 2010. Louca was named the prime suspect in the murder.

Louca skipped South Africa for Cyprus shortly after the shooting, but was extradited last year.

Louca’s murder trial was meant to start in January, but it emerged that Louca’s lawyers had made representations to the Director of Public Prosecutions in a bid to have the State drop the murder charges against him and for him to reveal who he said was responsible for Jackson’s death.

It is understood Louca has fingered alleged underworld kingpin Radovan Krejcir as the triggerman in the killing.
