Maspero discharged and back in dock

Cape Town - The teen accused of the murder of Clovelly mother Rosemary Theron has been discharged from Valkenberg Psychiatric Hospital and was back in the dock on Friday at the Western Cape High Court.

State advocate Susan Galloway told the court Kyle Maspero had completed a 30-day mental observation at the psychiatric hospital, but said she was unable to get hold of the report on the panel’s findings. She requested a postponement.

Maspero appeared cheerful on Friday as he chatted to his attorney, William da Grass.

Maspero was referred to Valkenberg after the State rejected his version of events when he wanted to plead guilty.

The teen claims he is unable to recall aspects of the offence because of his protracted use of drugs.

The forensic team at Valkenberg was tasked with determining his mental state at the time the murder took place.

Western Cape Judge President John Hlophe postponed the case to next month for a pre-trial conference.

Maspero is accused of murdering the mother of his girlfriend Phoenix Racing Cloud Theron, who is serving an effective 15 years in jail for the killing.

She entered into a plea bargain with the State in which she implicated Maspero.

According to Theron, she and Maspero came up with the plan to murder her mother after an argument.
