London - Lindsay Lohan's lawyer is convinced he can keep her out of jail.

The 'Liz & Dick' star - who recently fired her long time legal representative Shawn Holley - has reportedly convinced her new lawyer Mark Heller that she is telling the truth despite being accused of lying to police about being behind the wheel of her car during an accident in June and is said to have been assured by him that she will escape jail at her upcoming trial.

A source told gossip website RadarOnline.com: "Mark believes he can get Lindsay acquitted of all criminal charges stemming from her car accident in Santa Monica last summer. Lindsay has convinced Mark that she never lied to cops when they asked her if she was driving the car that day.

"There was a plea bargain offer on the table for Lindsay to go to rehab for nine months, but she absolutely refused that. Mark won't sign off on a deal that sends Lindsay to rehab for more than 60 days."

The 26-year-old troubled starlet - whose probation was revoked last month stemming from her latest charges - is also preparing to testify if necessary.

The source said: "There is talk of Lindsay taking the stand because she feels that once a jury hears her side of events she will be acquitted."

Despite being terminated, Shawn represented Lindsay in court last week, entering a not guilty plea on her behalf.

She told the judge she still technically represented the actress as she hadn't formally been removed from the case by the judge, which stopped the judge from issuing a bench warrant for Lindsay's arrest.

It was recently reported that 'The Canyons' actress owes her former lawyer $300,000 in unpaid bills.

The actress's new New York based lawyer has now obtained the necessary licence to practice in California.

The insider said: "Mark will be with Lindsay in court on January 30 at which point a date will be set for the trial. Lindsay's probation violation hearing would be held at the conclusion of the criminal trial. " - Bang Showbiz
