According to TMZ, Heather allegedly became combative and attacked an officer during the arrest, so was also picked up on three counts of misdemeanour battery on an officer.

Police had been called to the property by Heather's brother, after he arrived at house and saw the former 'Melrose Place' star fighting with her partner.

When officers arrived, they noticed a visible mark on the unnamed boyfriend.

When they tried to take Heather into custody, she kicked out and struck three deputies, and so she was handcuffed and taken to hospital for evaluation.

She was booked at 1.03am on Monday and released almost five hours later after posting bail.

A court date has been set for March 13.

The 'Too Close to Home' actress was previously arrested in September 2008 in connection with suspicion of driving under the influence and being under the influence of a controlled substance while she was behind the wheel in California.

At the time, an eyewitness claimed Heather was "revving her engine loudly, and backed over a pair of sunglasses several times".

And Tom Marshall, a spokesperson for the California Highway Patrol, revealed the actress was considered to be "under the influence of prescription medication" when the incident occurred.

Heather also pleaded no contest to misdemeanour reckless driving in January of 2009.

In light of that incident, the actress - who was previously married to rockers Tommy Lee and Richie Sambora, the father of her 20-year-old daughter Ava - accepted three years' probation, $700 in fines and attendance of a drug programme as her punishment.
