London - Britney Spears's parents have filed to have Sam Lutfi's lawsuit thrown out.

The singer's former manager accused Britney of breach of contract, while filed a battery claim against her father Jamie and now her dad and mother Lynne say he has no ground to stand on.

The legal documents state Britney never gave her "reciprocal assent" to pay Lutfi 15 percent of her income in exchange for his managerial services, which he claimed in his own lawsuit and during his testimony in court last week.

And, as for the the battery allegation, Lutfi "has not presented clear and convincing evidence that Jamie Spears acted either with intent to injure him".

Lutfi claimed Jamie injured him by hitting him in the stomach on the morning of January 29, 2008, hours after Britney was photographed and videotaped sitting outside her home and crying after jumping out of a car being driven by Lutfi.

However, the former couple - who are also parents to son Brian and daughter Jamie-Lynn - have not petitioned to dismiss Lutfi's libel claim based on Lynne's treatment of him in her 2008 memoir, 'Through the Storm: A Real Story of Fame and Family in a Tabloid World'.

A hearing on the motions for nonsuit (motions to dismiss) is scheduled for today (01.11.12). - Bang Showbiz
