Faerie Glen, Pretoria - Former Nigerian Olympic athlete Ambrose Monye, accused of murdering Pretoria mother Chanelle Henning, would have a problem living with his brother because they did not get along, the Pretoria Magistrate's Court heard on Friday.
Prosecutor Gerrie Nel told the court that the State would present evidence in the former Olympian's bail hearing to counter his claims of a fixed address.
A statement by Monye's brother, Peter, in which he said Monye could live with him and his fiancée in their flat in Montana pending his murder trial, was handed in as evidence in Monye's bail application.
Nel said he wanted to put on record that Peter Monye's rental agreement only made provision for two people living in the flat. The rental agent said it had not been arranged that a third person would be staying there, and objected to such an arrangement.
Peter Monye's statement was also in conflict with Monye's evidence that his brother stayed with his wife in a small flat in Sunnyside.
The rental agreement for the flat in Montana was signed in September last year Ä well before Monye testified Ä and would terminate at the end of August, Nel said.
The state would lead evidence that the two brothers did not see eye to eye, which would make Monye's residence with Peter problematic.
Peter Monye said in a statement that an advocate friend of Ambrose's had offered him a place to stay, but withdrew the offer after being aggressively questioned.
Peter Monye and his fiancée had agreed, after a family meeting, that his brother could live with them.
Nel previously accused Ambrose Monye of lying when he claimed police had assaulted him after his arrest.
Monye insisted his wrist had been broken, that his hand was still swollen, and that police had injected him and given him drugs.
He claimed he had not known Henning before the November 08 murder, and had never met her estranged husband, Nico.
Monye, Andre Gouws, Preshan Singh, Willem Pieterse and Pretoria police detective Gerhardus du Plessis were arrested in November in connection with Henning's murder.
Two men on a motorbike shot Henning dead as she was driving along Manitoba Drive in Faerie Glen, east of Pretoria. She had just dropped off her child at a pre-school.
Pieterse and Du Plessis in December last year pleaded guilty to Henning's murder. They are each serving an 18-year jail term for their roles in the murder.
Singh, currently out on bail, is negotiating with the prosecution about a possible plea bargain deal.
