Oscar’s brother not off the hook yet

Polokwane - The NPA has not yet decided whether to prosecute Carl Pistorius, brother of jailed paralympian Oscar Pistorius, on reckless and negligent driving charges following an accident outside Modimolle.

“The summons was prepared but we felt the need to take another look at the docket and have sent the docket back for investigations,” National Prosecuting Authority spokesman Velekhaya Mgobhozi said on Wednesday.

“As much as we have the summons ready, it was never served on Mr Pistorius and he was never charged. No decision has been made and it is going to be very difficult for me to pre-empt it.”

Mgobhozi said a decision would be made once the investigations were concluded.

On January 8, Limpopo police said Pistorius faced reckless and negligent driving charges.

At the time Colonel Ronel Otto said the decision was made earlier this month after Pistorius failed to submit a statement.

“The investigating officer obtained statements from the other parties and witnesses. Despite several efforts 1/8by the officer 3/8, Mr Pistorius did not submit his statement.”

The docket was sent to court where a prosecutor instructed that charges be laid against Pistorius, Otto said.

The matter would be heard in the Modimolle Magistrate's Court in February. Otto could not immediately provide the date.

The accident took place outside Modimolle, when Pistorius's car collided head-on with another in August last year.

He had to be freed from the wreckage with the Jaws of Life before he and the other driver were taken to hospital, both with serious injuries. Two passengers in his car were unhurt.

In May last year, Pistorius was acquitted on a culpable homicide charge following an accident in 2008 in which a motorcyclist died.
