The bail hearing for alleged underworld kingpin Nafiz Modack has hit another snag after two more people were brought to court yesterday.
Modack returned to Blue Downs Regional Court alongside Zane Kilian, Jacques Cronje, Ricardo Morgan and Sergeant Ashley Tabisher.
The state alleges that Modack ran the “Nafiz Modack enterprise” between October 2019 and September 2020 and his co-accused were affiliated with this enterprise.
They are facing a string of charges including the murder of Anti-Gang Unit head Liuetenent-Colonel Charl Kinnear and the attempted murder of attorney William Booth.
Yesterday, co-accused Amaal Jantjies and her berk Jannick Adonis were brought to Blue Downs Court for the first time since their arrests as the cases were joined.
Jantjies and Adonis are charged for the botched grenade attack on Kinnear’s home.
During proceedings, their lawyer raised an objection to them being required to attend the bail hearings of the other accused as their bail applications had already been finalised.
Their lawyer told Magistrate Deon van der Spuy that as Jantjies did not opt for bail and Adonis’ application was denied, they need not be part of the proceedings which have been dragging on for seven months now.
Van der Spuy agreed that they be excused and return to court in January next year while the remaining suspects will return on Friday.
Meanwhile, Modack’s legal team have informed the court of their plans to reopen the bail application amid disputes over electronic evidence.
This follows a legal tussle at the beginning of the bail hearings where Van Der Spuy ruled that the defence’s case be closed after the submission of just one affidavit from Modack.
But when the state then led their case, defence lawyer Dirk Uys insisted on a fair chance to respond.
