Johannesburg - Suspended Gauteng head of the department of health Barney Selebano's urgent application to set aside a subpoena instructing him to testify at the Life Esidimeni arbitration is set to be heard on Wednesday. 

Selebano had filed papers in the Johannesburg High Court challenging the subpoena. 

The suspended health official had been ordered to appear before the hearing next month. 

According to reports, Selebano's case, which was supposed to be heard on Tuesday, is now set to be heard at the high court on Wednesday. 

Selebano was suspended in the wake of recommendations by Health Ombudsman Malegapuru Makgoba following the death of 143 psychiatric patients at non-government organisations.

He and former Director of Mental Health Dr Makgabo Manamela then faced disciplinary action, with both of them facing seven and eight charges respectively. 

The two then challenged Makgoba's findings, resulting in their disciplinary cases being put on hold pending the court case. 

Selebano's appeal has since been dismissed by the independent ad hoc tribunal.

Dr Ernest Kenoshi, the former head of the Steve Biko Academic Hospital, was then appointed as acting head of department.
