Group slams Mfeka court action

Durban - While the KwaZulu-Natal government welcomed the interdict barring Phumlani Mfeka from hate speech, the induna of pressure group, Injenje yamaNguni, described the court action as an attempt to silence him.

The Daily News reported on Wednesday that Judge Kobus Booyens confirmed the order, recently sought by MECs, Willies Mchunu and Ravi Pillay.

Mfeka was interdicted from discriminating against or advocating violence against the Indian community or any other in KZN; and restraining him from inciting racial violence in any way.

In reaction to the order, the premier’s office said: “Anyone preaching hate speech or inciting people to violence should be under no illusions that our government will not do everything in its power to stop them in their tracks from propagating such position, which are not consistent with the basic tenets of the constitution of the republic.”

Efforts such as the recent procurement indaba and the special committee on social cohesion sought to address socio-economic transformation and the fostering of social cohesion. The report on social cohesion was imminent, the premier’s office added.

Mfeka said it was not unusual for the courts to be used by the State to “suppress, oppress and even used as a vehicle to kill those who spoke truth to the oppressive state”.

“It comes as no surprise that a white judge is able to grant such an order as the untransformed judicial system is left untransformed for this very reason, as it was white judges that had no qualms in dishing out horrendous sentences to our forefathers who fought a just cause,” he said.

Mfeka listed six “primary truths” that he said could never be silenced or suppressed, warning of bloodshed and devastation if the provincial government remained arrogant toward them.
