DURBAN - Transnet chief executive Siyabonga Gama will find out on Friday if he will keep his job at the company according to Business Live.
Gama earns R7,6 million a year at Transnet.
The chief executive approached the Johannesburg Labour Court this week in an attempt to stop the state-owned company's board from terminating his contract.
Gama was given 10 days by Transnet until 15 October to justify why his contract should not be terminated after investigations implicated him in the misconduct and maladministration in obtaining locomotives that are worth R54 billion.
The chief executive's lawyers wrote to the Transnet board threatening the company to go to court if the notice to terminate his contract was not retracted.
Gama wants the court to rule that the notice he received asking him to give reasons why he should not be dismissed, was unlawful and wrong. In an argument put to the court, the company accused the chief executive of abusing court processes by putting forward the urgent application.
Transnet said the court should be averse to allow a senior employee to steal an advantage by launching an urgent application and cutting the queue of cases that are pending in the court.
Popo Molefe, the chair of the Transnet board, said in a letter to the chief executive that the board had lost trust and confidence in him after the investigations into the buying of the locomotives.
The state-owned company is also demanding that he pay back R151 million in alleged overpay to Regiments Capital, a Gupta linked advisory firm.
Transnet argued to the court that the courts would not carry out a contract of employment where there was a lost in trust and confidence.
Dismissal
Last month, Gama was served a notice informing him of the Transnet board's intention to terminate his contract.
Molefe said in a statement that causes for chief executive's dismissal relate to the alleged serious breaches of Gama's financial, procurement and fiduciary duties as the head of Transnet.
